Terms of sale

Draft for review. These terms are a working draft for the test period. They should be reviewed by a solicitor before the first sale.

1. Who we are

These terms apply to sales by PLACEHOLDER: legal business name, PLACEHOLDER: registered business address, trading as Sparesure ("we"). We sell only to businesses, not consumers.

2. Quotes and orders

Information on this website is not an offer. A quote from us is valid for the period stated on it. A contract is formed when we confirm your order in writing after you accept the quote. We order parts from our suppliers after we receive payment, unless we agree otherwise in writing.

3. Condition, description and availability

Each quote states the condition (new-surplus, refurbished or used). Parts are sourced for you and availability is not guaranteed until confirmed on the quote.

4. Price and payment

Prices are as quoted, in the currency stated, exclusive of VAT unless stated. Payment is by bank transfer or card against our invoice, before dispatch unless agreed otherwise.

5. Delivery and risk

Delivery times are estimates. Risk passes on delivery. You are responsible for customs, import taxes and duties unless the quote says otherwise.

6. Warranty

We warrant that the part conforms to the quote and will be free from defects in function for 12 months from delivery. Our remedy is repair, replacement or refund. See the warranty page for exclusions.

7. Suitability and safety

You are responsible for checking that a part is suitable for your equipment and application, including any safety function. Install and commission parts using a competent person.

8. Liability

Nothing limits liability for death or personal injury caused by negligence, fraud, or anything that cannot be limited by law. Otherwise, our total liability for any order is limited to the price paid for that order, and we are not liable for indirect or consequential loss, including loss of production or profit.

9. Data

We handle personal data as described in our privacy policy.

10. Law

These terms are governed by the law stated on your quote, or if none, by the law of Ireland, and the courts of that jurisdiction have non-exclusive jurisdiction.
